Green Card Strategies for Business & Technology Professionals
You do not need an academic career to build a strong employment-based immigration case. Founders, executives, software engineers, AI professionals, business owners, product leaders, finance professionals, and other accomplished professionals may have valuable evidence in the real-world results of their careers.
Evaluate My QualificationsYour Strongest Evidence May Be Outside Academia
Extraordinary Careers Do Not All Look the Same
Many EB-1A and NIW discussions are written primarily for university researchers. That can create the mistaken impression that publications, citations, and academic peer review are the only meaningful forms of immigration evidence.
They are not.
A technology executive may have created hundreds of millions of dollars in value. A founder may have raised significant capital and built a growing company. A software engineer may have designed infrastructure used by millions of people. A finance professional may have led major transactions. A business owner may have created substantial revenue and employment.
The immigration strategy should identify how those real-world accomplishments fit the actual EB-1A or NIW legal standard.

Money

Responsibility
Leadership of important teams, systems, products, businesses, budgets, operations or strategic initiatives.
Innovation
New products, technology, processes, intellectual property, business methods or other original work.
Recognition
Awards, media, speaking, judging, selective organizations, customer recognition or industry acknowledgment.

Evidence from customers, investors, partners, independent experts, industry sources or other third parties.
EB-1A and NIW Reward Different Strengths
A successful professional should not choose a category simply because another person in the same occupation used it.
EB-1A: Your Existing Record
EB-1A focuses on extraordinary ability, qualifying achievements, recognition, sustained acclaim, and the strength of the applicant's record as a whole. For business professionals, high remuneration, major roles, original contributions and outside recognition can be particularly important.
NIW: Your Proposed Endeavor
NIW requires underlying EB-2 eligibility and focuses heavily on the proposed U.S. endeavor, its substantial merit and national importance, the applicant's ability to advance it, and whether waiving the usual requirements benefits the United States.
Could Your Career Support a Different Green Card Strategy?
Are You Highly Compensated?
High remuneration compared with others in the field can directly support one EB-1A evidentiary criterion.
Do You Lead Important Work?
Responsibility for significant companies, products, teams, systems or initiatives may support a leading or critical role analysis.
Can You Measure Your Impact?
Revenue, users, customers, savings, investment, growth, product adoption and other objective metrics may help establish significance.
Did You Build Something Important?
Technology, products, systems, methods or business innovations may provide evidence of original contributions.
Does Anyone Outside Your Employer Recognize You?
Media, awards, judging, speaking and independent industry recognition can help establish external validation.
Is Your Future Work Important Beyond One Company?
That question can be especially important when evaluating a National Interest Waiver strategy.
EB-1A & NIW for Nonacademic Professionals
Is EB-1A only for researchers and professors?
No. EB-1A expressly covers extraordinary ability in business as well as the sciences, arts, education and athletics.
Do business professionals need publications?
Not as a universal requirement. Scholarly authorship is one EB-1A criterion, not a requirement applicable to every extraordinary-ability case.
Can startup founders qualify?
Potentially. A founder must independently satisfy the requirements of EB-1A or NIW. Company ownership alone does not establish eligibility.
Can software engineers qualify without academic citations?
Potentially. The case should identify the evidence that actually applies to the engineer's career, which may include compensation, leadership, technical contributions, judging, recognition and product impact.
Does a high income help?
Yes, particularly in EB-1A, where high salary or other significantly high remuneration compared with others in the field is one of the regulatory criteria. It is not enough by itself.
Build the Green Card Strategy Around the Career You Actually Have.
If your record includes high compensation, leadership, entrepreneurship, innovation, significant products, commercial results, technology impact or industry recognition, we can evaluate how those accomplishments fit EB-1A, NIW or another strategy.
