EB-1A Final Merits Determination

The Second Step of EB-1A

The EB-1A Final Merits Determination

Meeting three EB-1A criteria does not automatically mean the petition qualifies for approval. USCIS then evaluates the evidence as a whole to determine whether the applicant has demonstrated the level of sustained acclaim and extraordinary ability required for the EB-1A classification.

The Biggest EB-1A Misunderstanding

Checking Three Boxes Is Not the Goal

The regulatory criteria are the entry point into the EB-1A analysis. They are not necessarily the ultimate measure of extraordinary ability.

An applicant might technically establish three criteria with relatively modest evidence. Another applicant might satisfy the same three criteria with evidence showing exceptional compensation, enormous professional responsibility and major industry impact.

Those records are not necessarily equivalent.

At final merits, USCIS evaluates the evidence together and determines whether the complete record demonstrates the required level of acclaim and professional distinction.

Build the petition backward from final merits.

Instead of asking only “Which three criteria can we meet?” ask “What does the complete record prove about this person's standing in the field?”

The Two-Step Framework

Initial Evidence vs. Final Merits

Step 1 — Regulatory Criteria

USCIS first determines whether the applicant has qualifying evidence of a major one-time achievement or satisfies the required number of regulatory evidentiary criteria.

The question at this stage is whether the evidence fits the particular criterion being claimed.

For example, does the compensation evidence establish high remuneration? Did the applicant actually judge the work of others? Was the claimed role leading or critical?

Step 2 — Final Merits

USCIS then evaluates all of the evidence together in the context of the complete petition.

The inquiry turns to the applicant's overall level of expertise, recognition, acclaim and professional standing.

The quality and significance of the evidence therefore become especially important.

What Strengthens Final Merits?

Evidence Should Show More Than Technical Satisfaction of a Criterion

Exceptional Compensation

Evidence showing remuneration far above appropriate professional peers may demonstrate more than simply satisfying the high-salary criterion.

Major Responsibility

Leadership of important companies, products, platforms, divisions or technical systems can demonstrate unusual professional standing.

Measurable Impact

Revenue, users, customers, deployment, adoption, savings and other objective results can show the real significance of an applicant's work.

Independent Recognition

Recognition from outside the applicant's immediate employer can help demonstrate that professional acclaim extends beyond internal praise.

Selectivity

Highly competitive awards, judging invitations, professional roles or other opportunities may be stronger when evidence establishes meaningful selectivity.

Consistency Over Time

A record of significant achievements across multiple years may help establish sustained rather than isolated professional recognition.

Industry Significance

Evidence showing that work affected important customers, organizations, technology, products or industry practices can strengthen the overall case.

Comparative Evidence

Reliable benchmarks can help explain why compensation, responsibility, performance or achievements distinguish the applicant from appropriate peers.

Corroboration

Important claims become more persuasive when multiple independent records support the same underlying fact.

The Final Merits Story

Three Questions the Entire Record Should Answer

The evidence should work together rather than read like unrelated boxes checked from the regulations.

Why Is This Person Different?

What distinguishes the applicant from ordinary successful professionals working in the same field?

Why Does the Field Value the Applicant?

What objective evidence shows unusually high compensation, responsibility, recognition, impact, demand or professional influence?

Is the Distinction Sustained?

Does the record show an ongoing pattern of high-level achievement rather than one isolated accomplishment?

Evidence Quality

Technically Sufficient vs. Persuasive at Final Merits

Weaker Record

Salary: Above-average compensation with a broad benchmark.

Critical role: Senior title and general employer letter.

Contribution: Created useful technology used internally.

Judging: Evaluated a small number of entries with little evidence of selectivity.

The criteria may deserve consideration, but the overall evidence may provide limited proof of extraordinary professional standing.

Stronger Record

Salary: Total compensation demonstrated to be exceptionally high among properly selected professional peers.

Critical role: Objective evidence establishes authority over a major product, business or technical function and substantial resulting impact.

Contribution: Technology is widely deployed, generates significant value or is independently recognized.

Judging: Applicant is repeatedly selected to evaluate significant work because of established expertise.

The evidence reinforces a consistent picture of professional distinction.

High Salary

Do Not Treat Compensation as Merely One Checked Box

Suppose an applicant establishes that total compensation substantially exceeds appropriate professional benchmarks.

That evidence may satisfy the high-remuneration criterion. But it can also raise an important final-merits question: why does the market compensate this person at such an unusual level?

Rare expertise, major leadership, significant business results, technical impact or unusually high demand may explain the compensation and connect the criterion to the overall extraordinary-ability analysis.

Leading or Critical Role

Show the Consequence of the Responsibility

A senior role becomes more persuasive at final merits when the evidence demonstrates why the applicant was entrusted with unusually important work.

Responsibility for major revenue, critical technology, strategic products, large teams, substantial budgets, important transactions or other core activities can help explain the applicant's professional standing.

The strongest evidence then connects that responsibility to measurable results.

Original Contributions

Major Significance Can Carry Substantial Final-Merits Weight

Evidence of an important original contribution can be especially persuasive when the contribution produced significant real-world consequences.

Commercialization, widespread deployment, major customers, industry use, revenue, technical improvements or other objective evidence can help demonstrate that the applicant's accomplishments stand apart from routine professional work.

Building for Final Merits

How to Strengthen the Complete EB-1A Record

1

Find the Strongest Achievements

Identify the accomplishments that most clearly distinguish the applicant from ordinary successful professionals.

2

Quantify Them

Use compensation, revenue, users, adoption, scale, responsibility, performance and other measurable facts.

3

Add Independent Validation

Use media, customers, awards, partners, judges, experts and other external sources where available.

4

Connect the Evidence

Explain why the criteria collectively demonstrate sustained recognition and the required level of extraordinary ability.

Frequently Asked Questions

EB-1A Final Merits FAQ

If I meet three criteria, do I qualify for EB-1A?

Not automatically. USCIS then evaluates the evidence together in the final merits determination.

Can USCIS consider the same evidence again at final merits?

Yes. Evidence considered when evaluating individual criteria may also be considered as part of the overall record in the final merits determination.

What does “small percentage at the very top” mean?

It reflects the high statutory and regulatory level required for extraordinary ability. There is no universal numerical percentile that automatically establishes the standard across all professions.

Is four or five criteria better than three?

More criteria can strengthen a case, but quantity alone does not determine approval. The quality, significance and overall persuasive force of the evidence are critical.

Can high salary help at final merits?

Yes. Particularly strong comparative compensation evidence may help demonstrate how the applicant is valued relative to others in the field, in addition to supporting the regulatory criterion.

What is the biggest final-merits mistake?

Treating the petition as a collection of unrelated criteria instead of building a coherent record demonstrating why the applicant has achieved the extraordinary professional standing required by EB-1A.

Build Beyond Three Criteria

A Strong EB-1A Petition Should Look Extraordinary When the Entire Record Is Viewed Together.

If your evidence includes high compensation, major leadership, significant original contributions, professional recognition, judging, awards, media coverage or measurable business and technical impact, we can evaluate not only which criteria you satisfy but how the complete record performs at final merits.
