What Is a National Interest Waiver?

The National Interest Waiver is part of the EB-2 employment-based immigrant classification. A person seeking NIW must first qualify for EB-2 through the advanced-degree or exceptional-ability framework.

Ordinarily, EB-2 cases involve a qualifying job offer and permanent labor certification. USCIS may waive those requirements when the applicant establishes that the National Interest Waiver standard is satisfied.

Because a qualifying NIW applicant may self-petition, the category can be particularly useful for founders, entrepreneurs, independent professionals and employees who do not want their permanent-residence strategy controlled entirely by one employer.

NIW is not reserved for academic research.

Business, technology, engineering, entrepreneurship, infrastructure, cybersecurity, AI, energy, finance, healthcare, manufacturing and other endeavors may potentially support an NIW when the required showing is made.

Step One

You Must First Qualify for EB-2

Advanced Degree

One route is qualification as a member of the professions holding an advanced degree or an appropriate qualifying equivalent under the immigration rules.

Exceptional Ability

The alternative is exceptional ability in the sciences, arts or business, requiring the applicable regulatory showing and a degree of expertise significantly above that ordinarily encountered in the field.

The Three National Interest Waiver Prongs

Prong One

Substantial Merit & National Importance

The analysis focuses on the specific proposed endeavor and its prospective impact rather than simply the importance of the applicant's occupation or industry.

National importance →
Prong Two

Well Positioned to Advance the Endeavor

Skills, experience, achievements, progress, resources, support, relationships and plans may demonstrate that the applicant is well positioned.

Well positioned →
Prong Three

Beneficial to Waive the Normal Requirements

The applicant must establish that, on balance, waiving the normal job-offer and labor-certification requirements benefits the United States.

The Center of the Case

The Proposed Endeavor Is More Than Your Job Title

One of the most important strategic decisions in an NIW case is defining precisely what the applicant proposes to do in the United States.

Too Broad

“I will work in artificial intelligence” or “I will continue working as an engineer” may identify a field or occupation but does not fully define a specific proposed endeavor.

More Useful

A stronger formulation identifies what the applicant plans to develop, improve, deploy, commercialize, lead or expand and explains why that work may have broader prospective consequences.

Building the Record

Evidence for a Business or Technology NIW

For nonacademic applicants, commercial and professional evidence may be more useful than an academic publication record.

Track Record

Past projects, products, technical achievements, leadership, transactions and demonstrated results.

Revenue & Market Evidence

Revenue, customers, adoption, growth, contracts and other evidence of real-world demand.

Funding & Investment

Venture funding, grants, institutional investment, committed capital and other financial support.

Industry Support

Evidence from customers, investors, industry leaders, government entities, partners and experts.

Concrete Plans

Business plans, development roadmaps, contracts, partnerships, hiring and commercialization plans.

Broader Impact

Evidence showing implications for technology, industry, infrastructure, economic activity or other U.S. interests.

Entrepreneurs

Can a Startup Founder Qualify for NIW?

Potentially. An entrepreneur may self-petition for a National Interest Waiver when the underlying EB-2 requirement and all three NIW prongs are established.

The existence of a startup alone does not establish national importance. The stronger analysis identifies what the founder proposes to accomplish through the business, why that specific endeavor has broader prospective importance and why the founder is well positioned to advance it.

Relevant evidence may include funding, revenue, customers, technology, intellectual property, investor support, partnerships, market evidence, prior entrepreneurial success and credible plans for future execution.

High-Income Professionals

Does a High Salary Qualify You for NIW?

High compensation may be useful evidence of professional success, seniority, expertise or market demand, but salary is not one of the three National Interest Waiver prongs.

The core NIW questions concern the proposed endeavor, its national importance, whether the applicant is well positioned and whether granting the waiver is beneficial on balance.

Case Strategy

How We Approach a Nontraditional NIW

1

Confirm EB-2 Eligibility

Establish the advanced-degree or exceptional-ability foundation first.

2

Define the Endeavor

Identify the specific work the applicant intends to advance in the United States.

3

Prove the Three Prongs

Develop objective evidence addressing national importance, positioning and the benefit of the waiver.

4

Connect Past to Future

Show how prior accomplishments establish credible ability to advance the proposed endeavor.

Choosing the Right Category

Should You File NIW or EB-1A?

NIW and EB-1A can both provide alternatives to the traditional PERM process, but the legal standards are fundamentally different.

EB-1A focuses heavily on existing extraordinary achievements and acclaim. NIW focuses on the future proposed endeavor and the national-interest framework.

Frequently Asked Questions

National Interest Waiver Questions

Do I need an employer to file an NIW?

No. A qualifying NIW applicant may self-petition.

Does an NIW require PERM?

A granted NIW waives the normal EB-2 job-offer and labor-certification requirements.

Do I need a PhD?

No. A PhD is not universally required, although the applicant must establish the underlying EB-2 classification.

Do I need publications or citations?

Not necessarily. The appropriate evidence depends on the field, endeavor, qualifications and NIW theory.

Can a business owner qualify?

Potentially. Business ownership alone is not enough; all applicable EB-2 and NIW requirements must be established.

Is high income enough?

No. Compensation may strengthen the record but does not replace the NIW requirements.
