Immigration Strategy for Extraordinary Careers
We help accomplished professionals pursue U.S. permanent residence through immigration strategies built around what they have actually achieved: leadership, compensation, technology, innovation, business impact, customers, funding, professional recognition and important future work.

Extraordinary Careers Are Not Limited to Academia
Many accomplished professionals assume EB-1A or NIW is reserved for professors, scientists with extensive publications, or researchers with hundreds of citations.
That assumption can cause successful founders, executives, engineers, software professionals, AI professionals, product leaders and business owners to overlook immigration strategies that may fit their careers.
Professional excellence is measured differently across industries.
A startup founder may be evaluated through funding, customers and market adoption. A senior engineer may be evaluated through systems, technology and measurable technical impact. An executive may be evaluated through organizational responsibility, compensation and business results.
Our role is to determine how the evidence produced by your actual profession fits the immigration standard USCIS must apply.
Translate Professional Achievement Into Immigration Evidence
Understand the Career
Before deciding which evidence matters, we need to understand what excellence actually looks like in the applicant's profession.
Identify the Legal Theory
The strongest petition begins with the applicable legal standard—not with a generic checklist of documents.
Find Objective Evidence
Compensation records, financial results, customers, technical documents, funding, contracts, organizational records and other evidence can establish facts that recommendation letters alone cannot.
Establish Individual Credit
Strong company results are valuable only when the record explains what the applicant personally created, led or accomplished.
Explain Significance
USCIS should be able to understand why a technology, business contribution, leadership role or other achievement actually mattered.
Build a Coherent Record
The strongest petition tells one consistent story across the legal brief, supporting letters and objective exhibits.
We Do Not Start With “How Many Publications Do You Have?”
The correct evidence depends on the profession.
Business Evidence
Revenue, growth, funding, customers, transactions, contracts, market expansion and organizational responsibility may reveal professional impact that does not appear in academic databases.
Technology Evidence
Deployment, users, scale, architecture, technical improvement, patents, commercialization and adoption can document major real-world contributions.
Professional Evidence
Compensation, awards, judging, selective memberships, media, leadership and independent recognition can provide additional evidence of distinction.
Built for Accomplished Professionals Outside the Traditional Academic Profile
Extraordinary Ability Based on the Complete Professional Record
EB-1A can allow a qualifying applicant to self-petition without PERM or a permanent employer job offer.
For business and technology professionals, the strongest evidence may include high remuneration, leading or critical roles, original business or technical contributions, judging, media, awards and other qualifying evidence.
Meeting individual criteria is only part of the analysis. The complete record must ultimately support the extraordinary-ability standard.

A qualifying EB-2 National Interest Waiver can also provide a self-petition strategy without the traditional PERM process.
NIW uses a different legal framework from EB-1A. The applicant must establish underlying EB-2 eligibility and then prove the national importance of the proposed endeavor, that the applicant is well positioned to advance it, and that the United States benefits from waiving the normal job-offer and labor-certification requirements.

Case Evaluation
We review the applicant's career and determine which immigration theory best fits the actual evidence.
Evidence Strategy
We identify what should be documented, what is missing, and which facts matter most.
Case Development
The legal argument, recommendation letters and supporting documents are developed around a coherent strategy.
Filing & Follow Through
The petition is organized for adjudication and the case is followed through the USCIS process.

The Messersmith Law Firm, P.A. represents clients in U.S. immigration matters from across the United States and around the world.
The firm's broader immigration practice has included individuals, universities, major companies, smaller enterprises and entrepreneurs.
That range of experience matters in EB-1A and NIW cases because extraordinary professional evidence can arise in many different settings: a global corporation, a growing startup, an engineering company, a technology platform or an independently owned business.
Our goal is not to force every applicant into the same evidentiary model. It is to understand the career first and then build the immigration case around the evidence that career actually produced.

Does the firm practice immigration law nationwide?
U.S. immigration law is federal, and the firm represents immigration clients located throughout the United States and abroad.
Does the firm only represent researchers and scientists?
No. We evaluate founders, executives, engineers, software professionals, AI professionals, business owners, finance professionals, product leaders and other accomplished applicants.
Does every client need publications or citations?
No. The evidence appropriate to an EB-1A or NIW petition depends on the applicant's profession, achievements and legal strategy.
Does the firm use flat fees?
The firm generally uses flat-fee arrangements for case representation, with the applicable legal fees stated in the engagement agreement.
Can the firm evaluate both EB-1A and NIW?
Yes. Where appropriate, the applicant's record can be evaluated independently under both classifications to determine which strategy—or combination of strategies—best fits the evidence.
Can the firm review a case after an RFE or denial?
Potentially. The existing petition and USCIS decision should first be reviewed to determine what was challenged and whether a viable response, refiling or other strategy exists.
We Build EB-1A and NIW Strategies Around the Career You Actually Have—not the Career Immigration Websites Assume You Have.
If you are a founder, executive, engineer, AI professional, software professional, business owner or another accomplished professional, we can evaluate whether your record supports EB-1A, NIW or another employment-based green card strategy.
