EB-2 NIW Evidence Checklist
A strong NIW petition is not simply a large stack of documents. Each important piece of evidence should perform a specific job: establish underlying EB-2 eligibility, define the proposed endeavor, prove national importance, demonstrate that you are well positioned, or support the balancing analysis.
Evaluate My NIW EvidenceThe Five Evidence Buckets
There Is No Universal NIW Document Package
A startup founder, software engineer, executive, physician, AI professional and manufacturing engineer may all qualify for NIW using very different evidence.
That is because NIW does not operate through a rigid checklist of professional accomplishments.
The evidence must fit the applicant's underlying EB-2 qualification, specific proposed endeavor and the three National Interest Waiver prongs.
Define the proposed endeavor and identify the strongest theory for each prong. Then collect the evidence needed to prove those specific claims.

What Should Each Document Prove?
The Fact
Establish what actually happened: funding, a product launch, customer adoption, project completion, technical improvement or another material fact.
Your Role
Show what the applicant personally created, led, developed or accomplished.
The Significance
Explain why that achievement matters to the proposed endeavor or one of the NIW legal prongs.
The Scale
Quantify customers, revenue, users, deployment, investment, savings, employment or another useful measure where appropriate.
The Independence
Where possible, show that customers, investors, government entities, partners or other outsiders validate important aspects of the claim.
The Future Connection
Explain how past accomplishments demonstrate an ability to advance the future proposed endeavor.
Three Common NIW Documentation Problems
Resume Without Proof
A resume identifies accomplishments but is usually more persuasive when the important claims are supported by independent or primary documentation.
Letters Without Documents
Strong support letters can explain evidence, but the case becomes more persuasive when objective records corroborate major claims.
Hundreds of Pages Without a Theory
Volume does not substitute for relevance. A smaller record organized around the actual NIW requirements can be substantially clearer.
Documents That Can Be Especially Useful
Contracts
Signed customer or partnership agreements can demonstrate actual market demand and progress.
Funding Records
Investment agreements and grant records may provide strong outside validation.
Revenue Records
Financial statements and other reliable records can document commercial traction.
Product Analytics
Users, transactions, deployment or adoption data can establish real-world impact.
Technical Records
Reports, project documents and engineering evidence can substantiate technical accomplishments.
Patents & IP
Intellectual property may demonstrate technology relevant to the endeavor.
Government Sources
Official reports can establish the importance of the underlying problem, technology or U.S. priority.
Customer Evidence
Customers and users can provide outside evidence that the applicant's work addresses a genuine need.
Independent Industry Evidence
Reliable external reports may provide context for economic, technological or industry significance.
Use the Writer Who Knows the Fact Best
Different writers may be useful for different parts of an NIW record.
A customer may explain why the applicant's product solves an important problem. An investor may explain why capital was committed. A technical expert may explain broader industry implications. An employer may explain the applicant's responsibilities and past success.
There is no need for every letter to repeat all three NIW prongs.
The stronger approach is to use each writer to establish facts or context that the writer is genuinely qualified to explain.
Your Strongest Business Evidence May Not Be Public
Business and technology professionals often rely on confidential records that do not appear on the internet.
Customer contracts, internal financial records, product metrics, technical reports, organizational documents and project information may contain highly valuable evidence.
The evidence strategy should determine how to document the relevant facts while appropriately protecting sensitive information where necessary.
Public evidence is useful, but a strong NIW petition does not need to pretend that all meaningful professional achievements occur in public.
Use Government Sources to Establish Context—not to Replace the Endeavor
Federal reports and strategies may be powerful evidence showing that a technology, industry, infrastructure problem or other issue is important to the United States.
But those reports should be connected directly to the applicant's specific proposed endeavor.
A government report saying that artificial intelligence is strategically important does not by itself establish that every AI professional has a nationally important endeavor.
The petition should explain the bridge between the national concern identified in the source and the work the applicant actually proposes to advance.
NIW national importance →How to Organize the NIW Evidence
Define the Legal Theory
Establish the EB-2 basis and identify the proposed endeavor before building the exhibit list.
Identify the Best Facts
Select the achievements, traction, expertise and outside evidence that most strongly support each prong.
Find Primary Documents
Use contracts, financial records, technical documents, government sources and other objective evidence wherever possible.
Add Context
Use letters and explanatory evidence to show USCIS why the objective facts matter under the NIW standard.
NIW Evidence Checklist FAQ
Is there an official fixed NIW document checklist?
There is no single evidence package that establishes NIW eligibility for every applicant. The required evidence depends on the applicant's EB-2 basis, proposed endeavor and the facts supporting each NIW prong.
How many recommendation letters do I need?
There is no fixed universal number. The quality, relevance and factual content of the letters are more important than reaching an arbitrary count.
Do I need a business plan?
Not every NIW applicant needs the same business-plan evidence. Business plans can be particularly useful for entrepreneurs when they credibly explain the endeavor and are supported by objective evidence.
Do I need publications or citations?
No universal publication or citation requirement applies to NIW. The appropriate evidence depends on the proposed endeavor and applicant's field.
Do I need government letters?
No. Government interest or support can be valuable in an appropriate case, but it is not a universal requirement for NIW.
Should I submit every professional document I have?
Usually the better approach is to select evidence that directly proves material facts under the EB-2 and NIW standards rather than adding documents solely to increase the page count.
Can internal company documents be used?
Potentially. Internal records may be highly useful when they reliably establish the applicant's accomplishments, responsibilities, progress or impact.
A Strong NIW Petition Is Not the One With the Most Documents. It Is the One Where the Important Documents Prove the Important Facts.
If your record includes significant technology, business achievements, leadership, customers, funding, products, partnerships, engineering work or other evidence, we can determine which documents best support your EB-2 eligibility and each National Interest Waiver prong.
