How to Prove You Are Well Positioned to Advance Your Endeavor
NIW does not require certainty that your proposed endeavor will succeed. Instead, USCIS evaluates whether your record, expertise, progress, resources, support and plans demonstrate that you are well positioned to advance the work you propose to pursue in the United States.
Evaluate My NIW EvidenceProng Two Looks at You
Why Should USCIS Believe You Can Advance This Endeavor?
Prong one focuses on the proposed endeavor and why it matters. Prong two shifts the focus toward the applicant.
The question is whether the applicant has the education, expertise, skills, record of success, resources, progress, relationships or other evidence showing a realistic ability to advance the proposed endeavor.
USCIS does not require the applicant to prove that future success is certain. Innovative, entrepreneurial and technical endeavors often involve risk.
The stronger record demonstrates that the endeavor is more than an aspiration and that this particular applicant has a credible path forward.
Show what you have already accomplished, what you are doing now, and why that record makes your proposed future work credible.
What Can Show That You Are Well Positioned?
Education
Relevant degrees and specialized training may help establish the knowledge needed to advance the proposed endeavor.
Professional Experience
Years of directly relevant work can demonstrate practical expertise, particularly when supported by meaningful accomplishments.
Record of Success
Past products, businesses, projects, technology or initiatives can show that the applicant has successfully advanced similar work before.
Progress Toward the Endeavor
Products, prototypes, pilots, research, technical work, market entry or other progress can demonstrate that the endeavor is already underway.
Customers & Users
Existing customers, users, contracts and market adoption may demonstrate real demand for the applicant's proposed work.
Funding
Investment, grants and other financing may show that outside parties have committed resources to the applicant or endeavor.
Partnerships
Commercial, institutional, technical or other partnerships can establish a realistic path for advancing the work.
Intellectual Property
Patents, proprietary technology and other intellectual property may support the applicant's ability to pursue a technology-based endeavor.
Plans & Models
A detailed business, technical or professional plan can help show how the applicant expects to move the endeavor forward.
Past → Present → Future
Past
What have you already built, led, developed, commercialized or achieved that demonstrates relevant ability?
Present
What current products, customers, projects, funding, partnerships or other progress demonstrate that the endeavor is real?
Future
What concrete plan explains how you intend to continue advancing the endeavor in the United States?
Objective Progress Can Be Especially Persuasive
Revenue
Existing revenue can demonstrate that a business endeavor has moved beyond speculation and achieved commercial traction.
Customers
Paying customers, enterprise clients and repeat users can validate demand for the product or service.
Pilots
Pilot programs can demonstrate real-world testing and institutional interest.
Funding
Outside investment may demonstrate confidence from sophisticated parties and provide resources for continued execution.
Partnerships
Relationships with established organizations may strengthen the credibility and execution path of the endeavor.
Deployment
Actual implementation of technology, processes or systems can demonstrate that the applicant is already advancing the proposed work.
Prior Success Is Often the Best Evidence of Future Capability
An applicant's strongest prong-two evidence frequently comes from work already completed before filing.
A founder who previously built successful companies may have evidence of fundraising, customers, growth and commercialization. An engineer may have successfully implemented similar technologies. A product leader may have launched products serving substantial users. An executive may have repeatedly led complex initiatives.
The closer those prior accomplishments relate to the proposed endeavor, the easier it may be to explain why the applicant is well positioned to advance the future work.
The case should focus on actual outcomes rather than relying merely on years of experience or prestigious job titles.
Traction Can Transform an NIW Entrepreneur Case
Entrepreneurs often have unusually rich prong-two evidence because the proposed endeavor may already be operating as a business.
Investment, customers, revenue, prototypes, intellectual property, employees, strategic partners and market adoption may all demonstrate progress toward the endeavor.
The strongest entrepreneur case connects those achievements directly to the future plan rather than relying only on a speculative business proposal.
A startup does not need to have completed its entire growth story before filing. But evidence that meaningful progress has already occurred can substantially strengthen the well-positioned analysis.
NIW for entrepreneurs →A Strong Resume Alone May Not Be the Strongest Prong-Two Case
Credentials Only
Advanced degree.
Ten years of professional experience.
Senior job title.
High salary.
These facts may demonstrate substantial professional qualifications, but they may provide limited evidence concerning actual progress toward the specific proposed endeavor.
Credentials + Execution
Relevant expertise and past success.
Product or technology already developed.
Customers, pilots or users.
Funding or institutional support.
Concrete plan for continued advancement.
This type of record connects professional qualifications directly to the applicant's ability to advance the endeavor.
Letters Should Explain Why the Applicant Can Execute
Customers, investors, collaborators, employers, industry experts and government officials may provide useful evidence concerning an applicant's ability to advance an endeavor.
A strong letter should explain how the writer knows the applicant's work, what the applicant has already accomplished and why the writer believes the applicant has a realistic ability to continue advancing the endeavor.
Letters become more persuasive when objective documentation corroborates their factual claims.
You Do Not Have to Guarantee Future Success
Innovative technology and entrepreneurial activity necessarily involve uncertainty.
The NIW framework does not require the applicant to prove that the proposed endeavor will ultimately succeed.
The relevant question is whether the record demonstrates that the applicant is well positioned to advance it.
That distinction allows USCIS to evaluate credible innovative endeavors without demanding impossible certainty about future outcomes.
An Important Endeavor Does Not Automatically Mean You Are Well Positioned
The proposed endeavor could involve an important national priority and still fail prong two if the applicant provides little evidence of the ability to advance it.
The opposite is also possible. An applicant may possess exceptional credentials but propose an endeavor whose national importance has not been adequately demonstrated.
That is why the NIW petition should separately prove each prong.
NIW national importance →How to Prove You Are Well Positioned
Define the Endeavor
Make sure the proposed endeavor is specific enough to determine what skills and evidence are relevant.
Map the Track Record
Identify past accomplishments that most closely demonstrate ability to advance similar work.
Document Current Traction
Collect customers, products, funding, partnerships, deployment, projects and other evidence showing actual progress.
Show the Path Forward
Explain how the applicant's resources, relationships and plan will allow continued advancement of the endeavor.
NIW Well Positioned FAQ
Do I need to prove my endeavor will succeed?
No. USCIS does not require proof that the endeavor is more likely than not to ultimately succeed. The applicant must demonstrate that the applicant is well positioned to advance it.
Does a PhD prove that I am well positioned?
A PhD can provide relevant evidence of expertise, but education alone does not automatically establish prong two. USCIS considers the complete record.
Can funding help?
Yes. Investment or grants may demonstrate outside support, provide resources for execution and corroborate progress toward the endeavor.
Can customers help?
Yes. Customers and users may demonstrate market demand and practical progress toward advancing a business or technology endeavor.
Do I need recommendation letters?
There is no universal requirement for a particular number of letters. Letters may be useful when they provide specific evidence concerning the applicant's achievements, progress and ability to advance the endeavor.
Can past success in a different company help?
Potentially. Prior accomplishments may be powerful evidence where they demonstrate skills and experience relevant to the proposed endeavor.
The Strongest NIW Case Shows That Your Future Plan Is a Logical Extension of What You Have Already Proven You Can Do.
If your record includes successful products, technology, business growth, customers, funding, leadership, projects or other significant achievements, we can evaluate how those facts establish that you are well positioned to advance your proposed endeavor.
