EB1 NIW Green Card

EB-2 NIW Requirements

EB-2 National Interest Waiver

What Are the NIW Requirements?

A National Interest Waiver can allow a qualifying professional to self-petition without the traditional permanent job offer and PERM labor certification process. But NIW is not simply a green card for people working in important fields. The applicant must first qualify for EB-2 and then satisfy all three National Interest Waiver prongs.

Prong 2 Well positioned to advance the proposed endeavor
Prong 3 On balance, beneficial to waive the job offer and labor certification requirements

The Most Common Misunderstanding

NIW Is Not a Standalone Immigration Classification

The National Interest Waiver operates within the EB-2 immigrant category.

That means the applicant cannot begin and end with the three NIW prongs. The applicant must first establish eligibility for the underlying EB-2 classification as either an advanced-degree professional or a person of exceptional ability.

Only after that threshold is met does USCIS determine whether the national interest justifies waiving the normal job-offer and labor-certification requirements.

There are really two analyses: EB-2 eligibility + NIW eligibility.

A strong Dhanasar argument cannot cure a failure to establish the underlying EB-2 classification.

Step One

First Qualify for EB-2

Advanced Degree Professional

One route is to establish that the applicant is a member of the professions holding an advanced degree or its qualifying equivalent.

An advanced degree generally means a U.S. academic or professional degree above a bachelor's degree or a foreign equivalent degree.

A U.S. bachelor's degree or foreign equivalent followed by at least five years of progressive post-degree experience in the specialty may also satisfy the advanced-degree equivalency rules in appropriate cases.

The proposed endeavor and the applicant's qualifications should also fit the underlying professional field relied upon for EB-2 classification.

Exceptional Ability

An applicant may alternatively qualify for EB-2 by demonstrating exceptional ability in the sciences, arts or business.

The regulations contain six categories of evidence, with at least three ordinarily required at the initial evidentiary stage.

The evidence must ultimately demonstrate expertise significantly above that ordinarily encountered in the field.

Exceptional ability can therefore provide an important route for accomplished professionals whose education does not fit the advanced-degree pathway.

Step Two

The Three National Interest Waiver Prongs

Prong One

Substantial Merit & National Importance

The proposed endeavor must have substantial merit and national importance. The analysis focuses on the specific endeavor the applicant proposes to advance.

A field can be important while a particular proposed endeavor still fails to establish national importance.

National importance →

Prong Two

Well Positioned to Advance the Endeavor

The applicant must demonstrate a record, resources, expertise, progress, support or other evidence showing a realistic ability to advance the proposed endeavor.

Past success can be highly relevant, but USCIS does not require certainty that the endeavor will ultimately succeed.

Well positioned →

Prong Three

On Balance, Waiver Benefits the United States

The final prong asks whether, considering the nature of the applicant's qualifications and proposed endeavor, it would be beneficial to waive the ordinary job-offer and labor-certification requirements.

This is not simply a repeat of national importance. It is a separate balancing inquiry.

Prong One

“My Industry Is Important” Is Not Enough

One of the most frequent NIW mistakes is proving the importance of the field rather than the national importance of the applicant's specific proposed endeavor.

Too Broad

“Artificial intelligence is important to the United States.”

Still Too Broad

“I will continue working as an AI engineer for U.S. technology companies.”

Better Direction

Define the particular technology, problem, industry application, business initiative or other endeavor the applicant intends to advance and explain its prospective broader implications.

The Proposed Endeavor

Everything Starts With Defining What You Actually Plan to Do

The proposed endeavor is more specific than a profession, job title or industry.

“Software engineer,” “entrepreneur,” “executive,” “AI professional” or “financial professional” describes a person or occupation. It does not necessarily identify the endeavor that USCIS must evaluate.

A strong proposed endeavor explains the work the applicant intends to advance, the problem or opportunity being addressed, how the applicant plans to pursue it and what prospective impact may result.

The rest of the NIW case should then remain consistent with that definition.

How to define the proposed endeavor →
National Importance

The Focus Is on Prospective Broader Impact

A proposed endeavor does not necessarily have to affect every person in the United States to possess national importance.

The analysis may consider broader implications involving technology, economic activity, industry development, public health, infrastructure, energy, national security, manufacturing or other important areas, depending on the facts.

But the petition should move beyond generalized statements and provide evidence explaining why this particular endeavor has broader prospective significance.

Prong Two Evidence

What Can Show That You Are Well Positioned?

Prior Accomplishments

A record of successfully completing similar work can help demonstrate the applicant's ability to advance the proposed endeavor.

Education & Expertise

Relevant training, specialized knowledge and professional expertise may support the applicant's ability to execute the endeavor.

Progress Already Made

Products, pilots, prototypes, customers, projects, research, partnerships or other concrete progress may demonstrate momentum.

Funding

Investment, grants or other committed resources may provide evidence that the endeavor has obtained outside support.

Customers & Market Interest

Contracts, customer adoption, letters of intent or market demand may demonstrate practical support for a business endeavor.

Industry Support

Letters from customers, experts, partners, government entities or other stakeholders may explain the applicant's positioning and the importance of the work.

Leadership Record

Prior responsibility for important technology, companies, projects or initiatives may demonstrate capacity to advance similar work.

Intellectual Property

Patents, proprietary technology and other intellectual property may support an endeavor where they are relevant to the applicant's plans.

Detailed Plan

A concrete and credible plan can help connect the applicant's background to the future endeavor.

Common NIW Mistakes

Three Arguments That Commonly Need More

“My Occupation Is Important”

The importance of an occupation or industry does not by itself establish the national importance of a specific proposed endeavor.

“I Am Highly Qualified”

Strong credentials can help establish EB-2 eligibility and the well-positioned prong, but qualifications alone do not establish national importance.

“My Employer Needs Me”

Value to one employer can be relevant evidence but does not automatically establish the broader prospective importance required for NIW.

Entrepreneurs & Founders

Business Success Can Help—but National Importance Is a Separate Question

Entrepreneurs may use funding, revenue, customers, employees, intellectual property, partnerships, market growth and other business evidence to support an NIW case.

Those facts may be particularly useful in showing that the entrepreneur is well positioned to advance the proposed endeavor.

But a successful company does not automatically establish national importance. The petition should explain the prospective broader implications of the specific business endeavor.

A local business can be economically successful without necessarily meeting that standard. A startup with broader technological, economic or industry implications may present a different factual record.

NIW for startup founders →
STEM & Technology

Working in STEM Can Be Helpful—but It Is Not Automatic NIW Eligibility

USCIS guidance gives particular attention to certain STEM endeavors involving critical and emerging technologies, U.S. competitiveness or national-security interests.

That does not mean every engineer, AI professional, software developer or cybersecurity professional automatically satisfies the NIW requirements.

The petition should still define the specific proposed endeavor and establish each of the three NIW prongs with evidence.

NIW for AI professionals →
High Salary

High Compensation Is Not an NIW Prong

High salary may demonstrate professional success, market demand and experience. It can be highly significant in an EB-1A analysis.

NIW uses a different legal framework.

There is no NIW prong asking whether the applicant earns a particular salary. Compensation may provide useful background evidence, but the petition must still establish EB-2 eligibility and all three national-interest prongs.

For a highly compensated applicant, the more useful question is often what achievements, expertise and responsibilities caused the market to value the applicant so highly—and how those facts relate to the proposed endeavor.

No Employer Sponsor

A Qualifying NIW Can Be Self-Petitioned

One of the principal structural advantages of the National Interest Waiver is that a qualifying applicant can file the immigrant petition without a traditional employer petitioner.

The NIW also requests waiver of the normal job-offer and labor-certification requirements associated with EB-2.

That can make NIW particularly relevant to founders, consultants, entrepreneurs, professionals changing employers and others whose careers do not fit comfortably into traditional employer-controlled PERM sponsorship.

Self-petitioning does not lower the substantive NIW requirements.

Practical Method

How to Build an NIW Case

1

Establish EB-2

Confirm advanced-degree professional or exceptional-ability eligibility before relying on the NIW framework.

2

Define the Endeavor

Identify precisely what the applicant proposes to advance in the United States.

3

Build the Three Prongs

Separate the evidence for national importance, well positioned and the balancing analysis rather than blending them together.

4

Corroborate the Claims

Use objective evidence, customers, experts, investors, industry sources, government materials and other credible documentation where appropriate.

Frequently Asked Questions

NIW Requirements FAQ

Do I need an advanced degree for NIW?

Not necessarily. The applicant must qualify for EB-2 either as an advanced-degree professional or as an individual of exceptional ability.

Can a bachelor's degree qualify?

In appropriate advanced-degree cases, a U.S. bachelor's degree or foreign equivalent followed by at least five years of progressive post-degree experience in the specialty may satisfy the advanced-degree equivalency rules.

Do I need an employer to file NIW?

No. A qualifying NIW applicant may self-petition.

Does NIW require PERM?

The purpose of the National Interest Waiver is to request waiver of the ordinary job-offer and labor-certification requirements for a qualifying EB-2 applicant.

Does working in AI or another important industry establish national importance?

No. The petition must establish the national importance of the applicant's specific proposed endeavor rather than relying solely on the importance of the field.

Does NIW move me out of the EB-2 visa backlog?

No. A National Interest Waiver remains an EB-2 immigrant classification. Visa availability continues to depend on the applicable EB-2 priority date, country of chargeability and Visa Bulletin.
