What Are the EB-1A Requirements?
EB-1A is one of the most demanding employment-based immigrant classifications, but it is also unusually flexible. There is no required employer sponsor, no PERM labor certification, and no universal requirement for a PhD, publications or academic citations.

EB-1A Is More Than a Three-Criteria Checklist
A common misunderstanding is that an applicant qualifies for EB-1A simply by checking three boxes from the regulatory list.
That is only the beginning of the analysis.
USCIS first evaluates the initial evidence. Unless the applicant has qualifying evidence of a one-time major internationally recognized achievement, the applicant ordinarily must satisfy at least three of the ten regulatory evidentiary criteria.
USCIS then evaluates the evidence together to determine whether the applicant has demonstrated the required level of extraordinary ability and sustained national or international acclaim.
The goal is to build a record that demonstrates an extraordinary career when the evidence is viewed as a whole.
How USCIS Evaluates an EB-1A Petition
Does the Evidence Meet the Regulatory Criteria?
USCIS determines whether the applicant has qualifying evidence of a one-time major internationally recognized achievement or satisfies at least three of the ten regulatory evidentiary criteria.
The focus at this stage is whether each particular item of evidence actually satisfies the language and requirements of the criterion claimed.
Does the Overall Record Establish Extraordinary Ability?
USCIS then considers the evidence in its totality to determine whether the applicant has sustained national or international acclaim and is among the small percentage who have risen to the very top of the field.
Strong evidence should therefore do more than technically satisfy individual criteria. It should reinforce the overall extraordinary-ability narrative.
EB-1A Regulatory Evidence
Not every criterion makes sense for every profession. Business and technology professionals should focus on the criteria naturally produced by their careers.
Why Strong Evidence Matters Even After You Meet Three Criteria
The final merits analysis is where the entire professional record must demonstrate the required level of extraordinary ability.
Quality Matters
Two applicants may technically satisfy the same criterion while having dramatically different evidence of achievement and recognition.
Significance Matters
USCIS may examine whether accomplishments reflect major professional importance rather than ordinary success expected from experienced people in the field.
The Record Must Work Together
Compensation, leadership, contributions, awards, judging, media and other evidence should collectively demonstrate the level of acclaim required by EB-1A.
Strong Criteria for Business & Technology Professionals
High Remuneration
Executives, engineers, finance professionals and technology leaders may have compensation that is significantly high relative to appropriate peers.
Leading or Critical Role
Responsibility for major companies, divisions, products, platforms, systems or strategic initiatives may provide powerful evidence.
Original Contributions
Products, technologies, business innovations, engineering solutions or other work may qualify when major significance can be established.
Judging
Professional awards, competitions, startup programs, technical review, conference activities and other qualifying judging may be relevant.
Published Material
Media or trade coverage about the applicant and the applicant's work may satisfy the published-material criterion when the requirements are met.
Awards
Competitive business, technology, engineering or professional awards can be useful where their recognition and selection standards are documented.
You Do Not Need to Manufacture an Academic Profile
A founder, executive, senior engineer or product leader may have an exceptional career without authoring scholarly articles.
The EB-1A regulations contain multiple independent criteria. Scholarly authorship is only one of them.
A nonacademic professional may instead have strong evidence involving high remuneration, leading or critical roles, original contributions, judging, awards, published material, memberships or other qualifying evidence.
EB-1A without publications →What If a Criterion Does Not Readily Apply to Your Occupation?
In appropriate cases, the regulations permit comparable evidence when the listed criteria do not readily apply to the applicant's occupation.
Comparable evidence is not simply an additional eleventh criterion. The petition should explain why a listed criterion does not readily apply and why the proposed evidence is genuinely comparable to the regulatory evidence contemplated for extraordinary ability.

Do I have to meet all ten EB-1A criteria?
No. Unless relying on qualifying evidence of a one-time major internationally recognized achievement, the applicant ordinarily must satisfy at least three of the ten regulatory criteria before USCIS proceeds to the final merits analysis.
Does meeting three criteria guarantee approval?
No. USCIS then evaluates the complete record to determine whether the applicant has demonstrated the required extraordinary ability and sustained national or international acclaim.
Do I need a PhD?
No. EB-1A does not impose a PhD requirement.
Do I need publications or citations?
No universal publication or citation requirement applies. The evidence depends on the applicant's field and which regulatory criteria are actually applicable.
Does EB-1A require an employer?
No. A qualifying applicant may self-petition, and EB-1A does not require a permanent job offer or labor certification.
Can business professionals qualify?
Yes. Extraordinary ability may be established in business as well as science, arts, education and athletics, provided the applicable legal requirements are satisfied.
The Question Is Not Whether You Can Find Three Criteria. It Is Whether Your Career Supports EB-1A.
If your record includes unusually high compensation, leadership, major technical or business contributions, professional recognition, judging, awards, media coverage or other significant achievements, we can evaluate how the complete evidence fits the EB-1A standard.
