High-Income Professionals

Does a High Salary Let You Skip PERM?

Not automatically. There is no general immigration rule allowing a person to bypass labor certification simply because they earn a high income.

High remuneration can, however, be directly relevant to an EB-1A petition because high salary or other significantly high remuneration compared with others in the field is one of the regulatory evidentiary criteria.

A highly compensated professional who also has evidence of significant leadership, recognition, innovation, or industry impact may therefore have good reason to evaluate EB-1A.

For NIW, compensation may strengthen the overall professional record, but it does not replace the requirement to establish EB-2 eligibility and all three National Interest Waiver prongs.
